Regulations require that
every teacher who is responsible for the implementation of a student’s
individualized education program (IEP) be provided a paper or electronic copy of
the student’s IEP prior to the implementation of the program.
The IEP must remain confidential, be kept in a locked file (paper copy)
and not be redisclosed to others.
The law also requires
that the special education teacher or related service provider inform the
regular education teacher of his or her responsibility to implement the
recommendations on a student’s IEP prior to the implementation of the IEP.
In addition,
paraprofessionals responsible for assisting in the implementation of a student’s
IEP have the opportunity to review a copy of the IEP, and have ongoing access to
a copy of the IEP. The teacher
under whose direction the paraprofessional works, will provide the access to the
IEP.

Amendments to Part 200 of the Regulations of the Commissioner of Education,
relating to the Education of Students with Disabilities as of April 17, 2003.
